Texas Prohibits Intentional Al Discrimination

Beginning January 1, 2026, Texas will prohibit employers of all sizes from using artificial intelligence (AI) systems with the intent to discriminate against members of a protected class.

Both federal and state law already prohibit discrimination against protected classes if an employer has 15 or more employees (and using Al, or any other tool, to discriminate wouldn't excuse it), but this new law applies to small employers as well.
