2026 Nebraska Midyear Roundup

Beginning July 17, 2026, Nebraska will join the ranks of other states with a mini-WARN law. Employers with 100 or more full-time employees that are undergoing a business closing or mass layoff will need to provide 90 days’ written notice to affected employees and the Nebraska Department of Labor. For purposes of determining coverage, an employee is considered full-time if they work at least 20 hours per week and have been employed for at least six of the preceding 12 months.


A business closing is the shutdown of a single site of employment or one or more facilities or operating units that results in an employment loss for 100 or more full-time employees. A mass layoff is a reduction in force that’s not caused by a business closing and results in the loss of employment for 100 or more full-time employees at a single site of employment during any 30-day period.


Employers don’t need to provide the full 90 days’ notice in certain situations, such as when the closing or layoff is caused by business circumstances that weren’t reasonably foreseeable or when a natural disaster occurs at the time the notice would have been required.


In addition to providing written notice to affected employees, employers will also need to post the written notice in a conspicuous location and in any language spoken by at least 5% of the workforce. LB 921 was signed by the governor on April 14, 2026.
