New Hampshire Lactation Law Updates
Starting July 1, 2025, employers with six or more employees in New Hampshire will be required to provide employees with certain lactation accommodations unless doing so would be an undue hardship. Including a lactation space within a reasonable walking distance of the employee's worksite (unless the employee and employer agree to a different location) that is clean, and (if feasible) contains an electrical outlet and chair. If the space isn't designated for lactation full time, it needs to be accessible to employees whenever they request it.
Employers will also need to adopt a policy that notifies employees about their lactation rights and make it available to employees upon hire.
Action Items
Update your lactation policy as needed and provide it to all new employees.
Designate a space in the workplace that can be used for lactation and make sure it complies with requirements.
